1. Acceptance of Terms

By accessing or using FloridaDatingService (the "Platform"), located at floridadatingservice.com, you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and our Cookie Policy. If you do not agree to all of these Terms, you must not access or use the Platform. Your continued use of FloridaDatingService after any modifications to these Terms constitutes acceptance of those changes.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and FloridaDatingService ("Company," "we," "us," or "our"). We operate an online dating platform that connects Western men with Asian women for the purpose of forming genuine, long-term relationships.

2. Eligibility and Age Requirements

You must be at least 18 years of age to create an account or use any feature of FloridaDatingService. By registering, you represent and warrant that:

  • You are at least 18 years old and have the legal capacity to enter into a binding agreement.
  • You are not prohibited from using the Platform under any applicable law in your jurisdiction.
  • You have not been previously suspended, removed, or banned from FloridaDatingService.
  • You do not have an existing account on the Platform (one account per person).
  • All information you provide during registration and profile creation is truthful, accurate, and complete.

We reserve the right to request proof of age or identity at any time. Accounts found to violate these eligibility requirements will be terminated immediately without notice.

3. User Conduct and Prohibited Activities

FloridaDatingService is committed to maintaining a safe, respectful environment for all members. You agree not to engage in any of the following prohibited activities:

  • Fake profiles or misrepresentation: Creating accounts with false information, using someone else's photos, or impersonating another person.
  • Harassment or abuse: Sending threatening, abusive, defamatory, obscene, or hateful messages to other users.
  • Solicitation or commercial use: Using the Platform to promote products, services, or solicit money from other members.
  • Fraudulent activity: Engaging in romance scams, phishing, catfishing, or any deceptive conduct intended to exploit other users financially or emotionally.
  • Illegal content: Uploading, sharing, or distributing content that violates any local, state, federal, or international law.
  • Data scraping or automated access: Using bots, crawlers, spiders, or any automated system to collect data from the Platform without express written permission.
  • Interference with operations: Attempting to disrupt, damage, or gain unauthorized access to the Platform's servers, networks, or security systems.
  • Prostitution or escort services: Using the Platform to offer, solicit, or facilitate sexual services for compensation.

Violations of these rules may result in immediate account suspension or permanent termination, at our sole discretion, without refund of any fees paid.

4. Account Registration and Security

When you create an account on FloridaDatingService, you agree to provide accurate and current information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorized use of your account.

We reserve the right to suspend, deactivate, or delete your account at any time if we reasonably believe that your account has been compromised, violates these Terms, or poses a risk to other users or the integrity of the Platform.

5. Intellectual Property Rights

All content on FloridaDatingService - including but not limited to text, graphics, logos, icons, images, software, and the overall design and layout of the Platform - is the exclusive property of FloridaDatingService or its licensors and is protected by United States and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from the Platform without our prior written consent. Any unauthorized use constitutes a violation of these Terms and may violate applicable copyright and trademark laws.

If you believe that content on our Platform infringes your copyright, you may submit a Digital Millennium Copyright Act (DMCA) takedown notice to our designated agent at [email protected].

6. User Content and License

By uploading photos, text, or other content ("User Content") to FloridaDatingService, you retain ownership of that content. However, you grant us a non-exclusive, royalty-free, worldwide, transferable, sub-licensable license to use, display, reproduce, modify, and distribute your User Content in connection with operating and promoting the Platform.

This license exists for the duration your account is active and for a reasonable period after deletion to allow for technical removal from backups and cached systems. You represent that you have all necessary rights and permissions to grant this license and that your User Content does not infringe upon the rights of any third party.

7. Limitation of Liability and Disclaimers

FloridaDatingService is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Platform's reliability, availability, or suitability for any particular purpose. Specifically, we do not guarantee that:

  • You will find a match, relationship, or marriage through the Platform.
  • Other users' profiles are completely accurate or that their intentions are genuine.
  • The Platform will be uninterrupted, error-free, or free from viruses or harmful components.

To the maximum extent permitted by law, FloridaDatingService and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses.

Our total aggregate liability to you for any claims arising from or related to these Terms or the Platform shall not exceed the amount you paid to FloridaDatingService in the twelve (12) months preceding the claim.

8. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law provisions. Any dispute arising from these Terms or your use of the Platform shall be resolved as follows:

  • Informal Resolution: Before filing any formal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally within 30 days.
  • Binding Arbitration: If informal resolution fails, all disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Miami-Dade County, Florida.
  • Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.
  • Small Claims Exception: Either party may bring qualifying claims in small claims court in Miami-Dade County, Florida.

9. Changes to These Terms

FloridaDatingService reserves the right to modify, update, or replace these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email or an in-platform notification. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. If you disagree with any modifications, your sole remedy is to discontinue use of the Platform and delete your account.
